    "Joseph Rogers claims damages for fraction 53-1-1 [for 1835] which we do not assess see William McGinnis; and John Anderson's Certificates on the subject"

    The following refers to notes left on GA_(Hutchins_Shaw_and_Kellogg)_BIA_12a_124 to 126. These notes seemed to have been copied verbatim from GA_(Hutchins_Shaw_Kellogg)_BIA_12b_5 and 6, although the notes left in 12b are far more difficult to read.

    "I hereby certify that sometimes about the month of March 1835 I went to Joseph Rogers and notified him that I had a certificate from the state's agent authorizing me to take and requiring him to give me possession of fraction 53 1st distinct 1st section on the Chattahoochee that said Rogers refused to comply with the requisition stating he would only do so when forced out at the end of the law and refused to let me have possession for the purpose of cultivating that year - John Anderson a tenant of said Rogers planted it by permission of Rogers as Rogers states to me but did not cultivate alleging that he expected I would turn him out of possession. I further certify that in the early part of the year 1836 said Rogers in pursuance of the above request and proceedings yielded up said fraction which contains about 25 acres river land and 10 acres upland and that I now have possession. I further certify it the times last aforesaid he was dispossessed of another part of his improvement in fraction 54 same districts at my instance containing 25 acres river land and 2 acres upland and that I have lost or mislaid said certificate from the agent.     "I hereby certify that I was the tenant of Joseph Rogers for the year 1835 that by his authority I parted the improved land on frac 53-1st district - 1st section and did not cultivate it for the reason that Mr. McGinnis Esquire informed that if any Georgian cultivated the land he intended to have the benefit of it but if Rogers wanted it he could have what he wished to cultivate. I mentioned this to Rogers and he told me I had better desist as McGinnis might get the crop after I made it so I desisted and the land lay idle that year.
