"Remarks: the whole of the above improvements were made by Obadiah Benge a white man under permit as miller, except the mill, it was understood that when Obadiah left the premise the whole of the improvements were to convert to John Benge. Obadiah left some months before the signing of the Treaty, and John Benge was in possession at the date of the Treaty, but was dispossessed under the laws of Georgia, about the 1st of March last, no conflicting Indian improvement"
